Welcome to BookFellows
Thanks for using BookFellows! These Terms of Service ("Terms") explain how you can use our platform. By creating an account or using BookFellows, you're agreeing to these Terms.
BookFellows is operated by Urgnt Limited, a company based in New Zealand. We provide our services to people around the world, and these Terms apply to everyone who uses our platform.
1. Using BookFellows
1.1 Who Can Use BookFellows
You need to be at least 13 years old to use BookFellows. If you're under 18, you should have your parent or guardian's permission to use our service.
1.2 Your Account
When you create an account, you're responsible for keeping your login details secure. Please don't share your password with others. Let us know right away if you think someone has accessed your account without permission.
1.3 Acceptable Use
We want BookFellows to be a positive, respectful place for everyone. When using our platform, please:
- Be respectful to other members
- Don't post content that's illegal, harmful, or offensive
- Don't spam or harass other users
- Don't try to hack or disrupt the service
- Don't copy or resell our content without permission
- Respect copyright and intellectual property rights
If we notice activity that violates these Terms, we may need to suspend or close your account.
2. Your Content
2.1 Ownership
You own all the studies, lessons, answers, and other content you create on BookFellows. We don't claim ownership of your work.
2.2 License to Us
To provide our service, you give us permission to store, display, and share your content as needed. For example, when you share a study with a group, we need to be able to show it to those group members. This permission lasts as long as you use BookFellows.
2.3 Responsibility
You're responsible for the content you create and share. Please make sure you have the right to use any materials you upload, including text, images, and other media. If you're sharing copyrighted material, make sure you have permission or that it falls under fair use.
3. Subscription Plans and Payment
3.1 Free and Paid Plans
BookFellows offers both free and paid subscription plans. Our free plan lets you participate in studies and create basic content. Paid plans include additional features like AI-powered study creation and enhanced group management tools.
3.2 Billing
If you choose a paid plan, you'll be billed according to the plan you select (monthly). Payments are processed in US Dollars (USD) and converted to your local currency at billing time depending on your location. You can cancel your subscription at any time from your account settings.
3.3 Refunds
If you're not satisfied with our service, please contact us within 14 days of your purchase and we'll work with you to make it right. This may include a refund, depending on the circumstances.
3.4 Changes to Pricing
We may change our pricing from time to time. If we do, we'll let you know at least 30 days before the change affects your subscription.
4. AI-Powered Features
Our StudyBot feature uses artificial intelligence to help generate study content. While we strive for accuracy and quality, AI-generated content may occasionally contain errors or unexpected results. You're responsible for reviewing and editing any AI-generated content before publishing it. The AI features are provided "as is" and should be used as a helpful tool, not a replacement for your own judgment and expertise.
5. Privacy and Data
Your privacy matters to us. Please read our Privacy Policy to understand how we collect, use, and protect your personal information. As a New Zealand company, we comply with the Privacy Act 2020 and take data protection seriously for all our users, regardless of where they live.
6. Ending Your Use of BookFellows
6.1 Closing Your Account
You can close your account at any time from your account settings. When you close your account:
- Your personal information will be permanently deleted
- Your studies and content will be removed
- Any active subscriptions will be cancelled
- Classes you're participating in will continue for other members, but your contributions will be removed
All we ask is that if you decide to delete your account that you consider transferring ownership of any active assets such such as studies, classes and groups to another member. When you select the option to delete your account, these assets will be shown to you with recommendations on how to transfer ownership.
6.2 We May Suspend or Close Accounts
We may need to suspend or close accounts that violate these Terms, engage in fraudulent activity, or pose a risk to our service or other users. We'll try to give you notice when possible, but we may need to act immediately in some situations.
7. Disclaimers and Limitations
7.1 Service Availability
We work hard to keep BookFellows running smoothly, but we can't guarantee the service will always be available or error-free. We may need to take the service down for maintenance or updates from time to time.
7.2 No Warranties
BookFellows is provided "as is" without warranties of any kind. We don't guarantee that the service will meet all your needs or be completely error-free.
7.3 Limitation of Liability
To the extent permitted by law, Urgnt Limited won't be liable for any indirect, incidental, or consequential damages arising from your use of BookFellows. Our total liability to you for any claims related to the service is limited to the amount you paid us in the past 12 months.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or anything else that can't be excluded or limited under New Zealand law.
8. Disputes and Legal Matters
8.1 Governing Law
These Terms are governed by New Zealand law. If you're based in another country, you may also have rights under your local consumer protection laws.
8.2 Resolving Disputes
If you have a problem with our service, please contact us first and we'll do our best to resolve it. If we can't work it out, disputes will be handled in the New Zealand courts, unless your local laws require otherwise.
9. Changes to These Terms
We may update these Terms from time to time. If we make significant changes, we'll let you know by email or through a notification on the platform. The updated Terms will take effect 30 days after we notify you. If you continue using BookFellows after that, you are agreeing to the new Terms.
